Agreement and Terms

­­­­1. By reading this agreement and by acknowledging so on the upload form, the participant (hereby referred to as “you”, “your”, and “the participant”) understands and agrees that all visual art and writing produced by you for this project, will be used solely for cultural and educational purposes, and will not be exploited in any way.

2. The participant authorizes Todd Edward Herman and east window to exhibit and publish reproductions of all visual art and writing that you produced for this project, in any catalog, journal, or online advertisement that may accompany this project, as well as in any gallery hosting an exhibition of this project.

3. You understand and agree that you own all original visual art and writing you produced for this project. You understand and agree that “original” includes all original visual art and writing made prior to digitizing and uploading your files.

4. You understand and agree that due credit-in-name will be given to your work unless you have requested to remain anonymous.

5. You understand and agree that if anyone is interested in purchasing your original visual art and writing Todd Edward Herman and east window will provide you with the purchaser’s contact information so you can establish your own terms with them and 100 percent of the sale price goes to you, the participant.

6. You understand and agree that all editorial and curatorial decisions regarding the exhibit or book, or rights of ownership of the exhibit or book are exclusively that of Todd Edward Herman & east window.

7. You understand and agree that your participation in this project is voluntary, and all visual art and writing produced by you are consensual, and therefore you release Todd Edward Herman, east window and employees from liability for any claims by you or any third party in connection with your participation.

8. You understand and agree that upon the completion of the exhibit all prints made from your entry will be archived at east window unless other arrangements are made wherein the participant personally transports their work. We cannot ship works.

9. You understand and agree that with your participation, this promises to be an amazing project !
